Serious Driving Charges Can Now Be Laid At Lower Thresholds

In case you missed it in the news drivers in Ontario can now be charged with serious driving offences at lower speeds.

Effective July 1, 2021 changes under the Moving Ontarians More Safely Act anyone caught driving 40 km/h or more above the speed limit in an 80km/h or less zone may now face stunt driving charges. The threshold has been dropped 10 km/h from 50 km/h over the limit on those roads.

Thresholds on roads posted at 80 km/h or higher remain the same.

The penalties for stunt driving have also increased substantially. These penalties now include:

  • 30-day roadside licence suspension
  • 14-day vehicle impoundment

The penalties are now escalating one and include post-conviction penalties for driver’s licence suspensions:

  • First offence - licence suspension for 1-3 years
  • Second offence - licence suspension 3-10 years
  • Third offence – lifetime suspension with the possibility of reduction
  • Fourth suspension – lifetime suspension

In addition to legal consequences, there are considerable insurance implications and fines and fees to pay. Drivers may also face mandatory driver education courses. Speed-related offences on Ontario highways have increased dramatically with Toronto reporting a 90% increase in racing and stunt driving charges between January and May 2021.
