Accident occurred even where there was no contact with vehicle

An accident can occur even when a pedestrian has not been hit by the vehicle. There does not require direct physical contact. The use of automobile sets in motion a train of events which brings about offence causing injury.

Entitlement to non-earner benefits requires a claimant to compare their 'normal life' before the automobile accident with their normal life afterwards. In this case the insured continued to do a significant amount of what she did before the accident.
